Car Body Panels Limited Terms & Conditions

Effective from 1st January 2016

We do our best to ensure that the correct part is supplied to you. However mistakes will occasionally occur so please note it is your total responsibility to check the quote/order/invoice to ensure that you have received the correct part for the vehicle. If you subsequently prep or paint the part it will be ineligible for credit, regardless of who is responsible for the error.

1. Contract

1.1. Car Body Panels Limited which trades under the name of Car Body Panels 4U ('the supplier') supplies its goods and services to its customer ('the client')

1.2. It is the intention of the supplier that all the terms of the contract applying to all transactions on the Car Body Panels 4U web site are contained in these terms and conditions

1.3. The supplier reserves the right to alter these terms and conditions without notice to the client. Changes will apply to any subsequent orders received

2. Delivery

2.1. Delivery dates and times given by the supplier are estimates only. Unless expressly agreed by the supplier in writing time is not and shall not be deemed to be of the essence of the contract, subject to delivery taking place within a maximum of 28 days

2.2. The client shall make all arrangements necessary to take delivery of goods whenever they are tendered for delivery. The supplier will only tender delivery of goods to persons aged over 18

2.3. Items are supplied subject to their availability. Whilst the supplier will endeavor to hold sufficient stock to meet all orders, if there is insufficient stock to meet your order, the supplier may at their discretion contact the client to offer a substituted product or alternatively refund the price paid for such goods as soon as possible

2.4. The supplier reserves the right to change details and/or product specifications without notice

2.5. The supplier reserves the right to make delivery by installments and tender a separate invoice in respect of each installment. The supplier's failure to deliver one or more installments or any claim by the client in respect of any one or more installments shall not entitle the client to treat the contract as a whole to be repudiated

2.6. Please note a signature is required on delivery. If we are unable to deliver because there is no one to receive the goods at the shipping address we will charge £12 (£36 for Ireland) for re-delivery invoiced separately. If an attempt is made to deliver your order and you later decide to request a refund, £12 (£36 for Ireland) will be deducted from the refund amount

2.7. For imported parts lead times are one to two weeks and are non-refundable. It is the customers responsibility to ensure the correct parts have been purchased

2.8. Delivery Address: It is your responsibilty to ensure you supply us with the correct shipping address, including the POSTCODE.  Any errors in the shipping address that are charged by our couriers to us will be charged to the (client)

  • The Highlands and Islands of Scotland (Postcodes HS,IV,KA-27,28,KW, PA-20-49, PA60-78, PH17-26, PH30-44, PH49-50,ZE) Northern & Southern Ireland.

3. Returns, Refunds & Cancellations

3.1. Refunds will only be made to the original payment method used. credit/debit card or PayPal account that was originally used to complete the transaction within 28 days

3.2. Refunds for postage and packaging will not be issued

3.3. Refunds will be issued once the items have been received by Car Body Panels 4U in good condition complete with all original packaging and labels

3.4. If you require a replacement, please call the office while the driver is still with you. If the item is repairable, a discount can be agreed for you to keep the part

3.5. Any items that are a "special order" i.e imported or ordered in for you are non refundable.  It's essential that the correct parts are ordered

3.6. Parts must be returned in original condition and suitable packaging

3.7. Prepped or painted parts are non-returnable

3.8. Parts returned are subject to the following handling charges:

  • 0 - 7 days 25%
  • 7 - 14 days 50%
  • Over 14 days - We do not accept any parts back after this time

 3.9. For safety reasons, all items must be returned free of contamination such as fuel, oil, grease or coolant etc. Items returned in a contaminated state will be subject to a 50% handling charge unless previously agreed with a member of the quality team

4. Damaged Parts & Inspection

4.1. All parts MUST be checked on delivery. The client shall inspect the goods at the place and time of receipt.  Any damage to the goods should be reported to the courier at this point and either not signed for or signed but in damaged condition

4.2. Any damaged parts can be rejected on delivery

4.3. We do not accept any claims for damage after delivery

4.4. The client must advise the supplier by telephone within 7 days of receipt, of any claim for short delivery or carriage

4.5. If you require a replacement, please call the office while the driver is still with you. If the item is repairable, a discount can be agreed for you to keep the part

4.6. The supplier shall not be liable for indirect or consequential loss or damage including without limitation loss of profit, of use, or of contracts arising out of the supply or failure of supply of goods (other than liability for death and personal injury resulting from the negligence of the supplier) and whether arising in contract, tort or otherwise. In all other cases liability shall be limited to the contract price

4.7. If the client does not give notice within 7 days the goods will be deemed to have been delivered in the quantities shown in the delivery documents and the Client shall not be entitled and will irrevocably and unconditionally waive any right to reject the goods or claim any damages whatsoever for short delivery howsoever caused

4.8. The suppliers liability for short delivery is limited to making good the shortage

4.9. All panels, bumpers & Lamps are NON genuine and are aftermarket replacement parts

4.10. Credit on damaged goods cannot be issued if goods are signed as received in good condition. Car Body Panels 4U must be made aware of any damages immediately upon receiving the item, Customers are liable for all the returms charges by the courier

5. Poor Fitting Parts

As we do not accept prepped or painted parts for credit it is advisable to dry fit all parts

5.1. All incidents of poor fitment must be reported at the point of fault

5.2. No claims for poor fitment will be accepted on parts that have been painted

5.3. All parts must be checked as being correct for the application prior to preparing or painting

5.4. We do not cover the cost of OE replacement parts or the difference in cost between our part and the OE equivalent

5.5. We do not cover the costs of courtesy/hire/replacement vehicles or the cost of vehicle recovery

5.6. We do not cover any costs incurred by the use of a third party, including but not limited to:

  • MOT Tests/Re-tests
  • Diagnostic work
  • Vehicle Inspections
  • Vehicle Recovery
  • Personal transport

5.7. Any item found to be damaged will be treated as a damaged item and the above terms regarding damage will take precedence

5.8. We reserve the right to inspect a vehicle with our parts fitted if required

6. Payment Terms

6.1. The risk of loss or damage to the goods shall pass to the client upon delivery of the goods

6.2. All goods will remain the property of Car Body Panels until paid for in full

6.3. You are to indemnify us in full and hold us harmless from all expenses and liabilities we may incur (directly or indirectly including financing costs, including legal costs on a full indemnity basis and the cost of instructing a debt recovery agency to recover a debt due to us if any) following any breach by you of any of your obligations under these terms

6.4. Clients who shop online must be aged 18 years or over

6.5. By placing an order through the web site the client authorizes the supplier to debit their credit or debit card for the total amount of the order prior to the dispatch of the goods to the client's delivery address, unless other credit terms have been agreed previously in writing

6.6. Please note items that are shown as in stock maybe unavailable based on our suppliers stock levels. If your item purchased is unavailable then your credit card will be credited within three to five working days

6.7. Whilst every effort is made to ensure that the correct price is displayed on our web site, errors may occur. If the Supplier discovers that such an error has been made in the quoted price, the client will be contacted to confirm this

6.8. The client will then be given the option of canceling the order or re-confirming it at the correct price. If the supplier is unable to make contact with the client the order will be treated as cancelled

6.9. The supplier reserves the right to change prices and details at any time without notice

6.10. Postage & packaging price may increase depending on the size or weight of the items

7. Warranty

7.1. Except where goods are sold to a person dealing as a consumer within the meaning of the Unfair Contract Terms Act 1977 all warranties, conditions or other terms implied by statute or common law are excluded to the full extent permissible by law

8. Risk

8.1. The risk in goods sold to the client shall pass to the client so that the client is responsible for loss, damage or deterioration of the goods or a part thereof at the time of delivery
